Benami Transactions (Prohibition) Act 1988, which was often disregarded, has increasingly gained traction in the recent times. While this law was enacted way back in 1988, it remained largely inactive due to lack of provisions for enforcing the same. The Modi Government in its first term enforced the law by notifying the amended law in 2016. Further, the enforcement of the Benami law was entrusted to the Income Tax Authorities. Lately, several Corporate structures and transactions have been challenged by invoking the Benami law provisions. In addition, the Benami law has interplay with corporate and other allied laws with adds to further complexities.
